The bill (Reg. No.6523) improves Ukrainian legislation on copyright and related rights as to collective management of property rights of copyright and related rights proprietor and its harmonization with the requirements of the European Union.
Pursuant to the bill, copyright and (or) related rights proprietor can transfer their property rights in trust to the corporate management organizations on a collective basis.
Pursuant to the document, copyright and (or) related rights proprietor can also transfer their property rights on a collective basis in trust to the business entity that acts on the basis of state property form, foundation documents of which envisages functions of the organization with the collective management.
Pursuant to the document, organizations with the collective management are to be founded by the copyright and (or) related rights proprietors that can individual person and (or) legal entity taking into the consideration paragraph 2, part 1 of this clause.
The bill also specifies that in the sphere of reprography, pursuant to clause 25-1 of this Law, organization with collective management can be formed by the authors and (or) publishers of the works. Organizations with collective management are supposed to possess the status of legal entity pursuant to the requirements of the Law.
Relevant amendments are introduced to the Law "On Copyrights and Related Rights", the Code of Administrative Infringements of Ukraine, the Civil Code and other legislative acts of Ukraine.
